Emerald HideAway, LLC Rental Responsibility Agreement

All Contracts MUST be signed & faxed/mailed to our office in 2 business days from time of booking or you lose your dates.

BY SIGNING THIS AGREEMENT BELOW, YOU ARE AGREEING TO BE BOUND BY AND ARE BECOMING A PARTY TO THIS RESPONSIBILITY AGREEMENT

Check-In Time is 3:00 PM on the day that your scheduled reservation begins.  When arriving at Emerald HideAway there is no large commercial sign to mark the property, the name is on the mail box, look for the blue reflective sign with the number 17996 to indicate the right driveway. (Check-in time can be adjusted if needed provided there is no renters immediately prior to your visit - call Larry at 507-240-0030 to make alternate arrangements)

Check-Out Time is 10:00 AM on the day that your scheduled reservation ends. Your cooperation in adhering to our established check-out time will be greatly appreciated by both our housekeeping staff and incoming guests (see rule #3 under Security/Damage Agreement). (Check-out time can be adjusted if needed provided there is no renters immediately following your visit - call Larry at 507-240-0030 to make alternate arrangements)

Prior to departure, the guests are expected to wash all dishware and put it away in the proper location. All household trash, garbage, and/or other discarded items should be properly bagged-up so as to avoid spillage/leakage and then properly deposited in the garbage area. If leaving the premises before staff arrives to check you out please make sure all windows & doors are locked, all appliances are turned off, and leave all keys on kitchen counter.

PAYMENT: Payment in full is expected at the time of arrival. Emerald HideAway accepts check, cash, Visa and Master Card. If paying by check there will be a $27.00 charge for any returned checks.

SECURITY/DAMAGE AGREEMENT: A Visa or Master Card is required at the time you reserve Emerald HideAway with a $300.00 security deposit charged to the card. The undersigned is agreeing that cancellation fees and costs for any repairs/replacement may be taken off that credit card if damages occur to the property during the guests stay. This deposit IS NOT included in the rent total which is due in full at the time of check-in.  This deposit will be held by Emerald HideAway until after check-out when the property can be inspected for damages or loss then returned to the renter in full or part depending on any repair or replacement costs.

1. Guests are individually and severally liable and otherwise fully responsible for any and all guests and/or invitee caused damages incurred to Emerald HideAway property, including but not limited to all adjacent structures and premises, throughout the entire duration of their stay. This includes, but is not limited to, intentional and/or unintentional removal of Emerald HideAway Owners personal property (belongings), willful and/or accidental damage to structures and premises including, but not expressly limited to any and all fixtures, appliances, furnishings & amenities. Guests shall be charged at full cost of repair and/or current replacement, including labor and materials, removal and disposal, plus taxes and surcharges as applicable.

2. A $25.00 replacement fee shall be assessed to guests that fail to return any and all Emerald HideAway related keys.

3. Failure to vacate Emerald HideAway on the scheduled date of departure by our established check-out time of 11:00 AM (unless other arrangements have been made ahead of time) shall result in immediate assessment of a fee equivalent to the sum of one additional night’s rental rate, plus tax, with all such costs being charged to the guest.

4. Emerald HideAway and it’s owners shall not be held liable nor otherwise responsible in any way for guests personal property that is damaged, lost or stolen, and upon endorsing this agreement, guests agree to forever hold harmless and indemnify Emerald HideAway’s Owners from any such liability/responsibility. If found; upon guests request, personal property that has been lost or left behind will be returned to the guest and guest will be charged a $25.00 handling fee plus all applicable shipping costs.

HOME MAINTENANCE/HOLD HARMLESS: While Emerald HideAway owners & staff strive to maintain the property in the finest condition, there are no specific guarantees provided. Repairs and/or replacement will be made as soon as possible under prevailing circumstances. As such, it is the guests responsibility to immediately notify of any and all difficulties that they experience during their stay, so that appropriate measures can be taken as needed in a timely manner. Inconveniences under which we may have no immediate control and which do not warrant any refund of rental monies include: (1) breakdown of TV, VCR-DVD player or any other recreational appliances/devices; (2) power outages; (3) adverse road and/or weather conditions; (4) construction taking place in the area; (5) environment that is not decorated and/or otherwise accommodated to suit the guest individual tastes. All guests and their invitees use Emerald HideAway structures & premises at their own risk. Emerald HideAways owners shall not be held liable nor otherwise responsible in any way for inuury to any guests and/or their invitees, that is caused or permitted to be caused by the intentional or unintentional acts of said guests and/or invitees (including their pets), or by the failure of structures, appliances, furnishings, and/or other equipment, whether by malfunction, misuse, acts of God/Nature, and/or other naturally occurring events. No guarantees are expressed nor implied as to the fitability of utilities and/or other services provided to Emerald HideAway, it’s structures & premises. No guarantees are expressed nor implied regarding the fitability/suitability/compatibility of materials utilized in the construction of Emerald HideAway structures, property and/or contents therein. Emerald HideAway owners shall not be held liable nor otherwise responsible in any way for allergic reactions to it’s guests and/or their invitees, caused or permitted to be caused by materials utilized in the manufacture of the structures, and/or it’s contents in and on the premises, including mold, airborne spores, pet/animal allergens, and/or chemical agents utilized in the care and cleaning/maintenance of the property, it’s structures & premesis including but not limited to appliances, linens, carpeting, utensils, fixtures, and/or other equipment. By endorsing this agreement, guests hereby agree to forever hold harmless and indemnify Emerald HideAway owners & staff from any liability/responsibility arising there from.

OCCUPANCY LIMITS: Adherence to designated occupancy limits at Emerald HideAway is strictly enforced. Overcrowding violates local health codes and fire ordinances, and is considered grounds for immediate eviction from the property with guests forfeiture of any and all monies paid.

SMOKING & PETS: Smoking is not permitted inside any of the buildings at Emerald HideAway or on the wood decks. All cigarette butts must be disposed of in a safe manner. A kennel with dog house is provided just outside the house and dogs are permitted to be on the premises with prior approval but NO pets are permitted inside any of the buildings or on the wood decks at Emerald HideAway. Any indication that these restrictions have been violated will result in forfeiture of the entire deposit amount.

The following are items provided by Emerald HideAway for Guests use during their stay:

All Bedding & Pillows & some blankets (you may want to bring extras); 1 Baby Crib

Towels; Hangers in closets

Dishes, kitchen utensils & appliances; Iron & Ironing board

Dish & Laundry Soap; Cleaning Products & Garbage bags; Toilet paper

Puzzles; Video Library with a range from Children’s to Rated R Movies

Fire Wood; Charcoal Grill

Basic Crafting Equipment

Phone with local access only 

The following are items that guests will be responsible for supplying themselves during their stay:

Toiletries; Sunscreen & Bug repellent

Food Staples (Jimmy’s Pizza in Atwater delivers to Emerald HideAway and offers a wide variety of Pizza, pasta & sandwiches. A menu is provided at the house)

Paper Products (napkins, paper plates, paper towels, facial tissue, etc.)

Fishing Equipment (tackle, rods, etc.)

Charcoal for Grill

Specific Crafting Supplies (special cutters, material, paper, stamps, ink, etc.)

Cell phone for long distance calls

Water socks/shoes

Slippers for Craft/Rec Room

POLE BARN & LOCKED CLOSET: Please be aware that the 2 locked closets in the home and the pole barn (machine shed) on the property are the owners private areas and off limits to guests & their invitees and are not to be entered under any conditions. If it is discovered that these areas have been broken into after departure, guests will be charged the full replacement cost for all items that are missing plus any expenses that are incurred to replace damaged locks, doors, etc.

Access to Home: Guests will be given the code to a keyless entry door.  This code is changed after every check-out.

LOCKOUTS: If you lose/forget your code for the house, call Larry at 507-240-0030. 

FIREWORKS: Most fireworks are not legal in Minnesota and fireworks are not allowed to be set off on the property including any of the Emerald HideAway boats. If guests choose to ignore the law and set off fireworks, they do so at their own risk. Emerald HideAway & it’s owners are not responsible for accidents or damage caused by firework usage. Guests will be responsible for repair/replacement cost of any damage to Emerald HideAway property by the use of fireworks.

CANCELLATION POLICY: If cancellation is received at least 30 days prior to guests scheduled date of arrival, the booking deposit will gladly be refunded less a $50.00 service charge. Cancellation with in 29-21 days of arrival date will result in the forfeiture of the $300.00 booking deposit. Cancellation within 20 days will forfeit entire rental amount unless it can be re-rented . In that case, the difference in the two total rental amounts or a $50.00 service fee will be charged to the cancelling party, which ever amount is greater.

ENTIRE AGREEMENT: This agreement, when combined with any and all community rules and regulations constitutes the entire agreement. No additional provisions are expressed nor implied. This supersedes any and all previous agreements, whether oral or written, expressed or implied. Upon signing, the guests hereby endorse the fact that they have read and understand this agreement in its entirety, and agree to accept all of its terms, conditions and restrictions without exception.

DEFINITIONS: The “Guests” mentioned above refer to those individuals who have signed this agreement and are individually and severally liable and otherwise directly responsible for the actions of all members of their party including, but not limited to family members, associates and invitees. All costs of accommodation including, but not limited to loss, damage and/or fines are considered to be the full and complete responsibility of the guests, regardless of whether or not the guests were actually present at the occurrence.

RATES: All Rates based on maximum of 14 guests total. Weekends cannot be split. Minimum of two night stay per visit, be sure to indicate how you would like the craft/rec room set-up at time of booking. 

LAKE HOME RATES High Season:

2nd full week in June thru 2nd full week in August

LAKE HOME RATES Off Season

3rd weekend in August to 2nd weekend in June

*Note Weekends cannot be split

** Note Weekday rates must be a minimum 3 night stay.  If you are a crafter and are interested in only a two night stay during the week contact us for information on requirements and availability.
